Comment on draft rules for voluntary stream restoration weirs (HB 2298) by Nov. 26

SALEM, Ore.—On May 21, 2021, Governor Kate Brown signed House Bill 2298. This bill gave ODFW one year to adopt rules and administer a program for authorizing voluntary environmental restoration weirs on incised or eroded stream in Eastern Oregon's closed basins (basins that do not flow to the Pacific Ocean).

The rules are designed to permit the construction of environmental restoration weirs in qualifying streams. The weirs cannot be built in streams with healthy native migratory fish populations, and if fish are present in the stream, environmental restoration weirs are required to provide fish passage. Weirs built under this program can only be as large as necessary to cause overbank flooding onto the ancient floodplain during ordinary high flow events.

ODFW began the rules development process for House Bill 2298 this spring. The current draft rules are a result of public comments solicited in August and input received during two rules advisory subcommittee meetings. Additional information, links to the draft language, and legislative history are posted in the House Bill 2298 box on the ODFW Rules Revision Initiative website.

Comments will be considered (and additional public comments taken) at the Fish Passage Task Force meeting on Dec. 3, 2021. After input by the Fish Passage Task Force, the draft rules will be presented to the Oregon Fish and Wildlife Commission for adoption.
